ESSENTIAL JOB FUNCTIONS
The City of Houston seeks a commercial litigation attorney with at least 6 years of experience to handle civil commercial matters, as well as litigation involving City ordinances, election contests, civil rights and state and federal constitutional issues.
Responsibilities include, but are not limited to:
- Representing the City of Houston Housing and Community Development Department (HCDD) in various affordable housing acquisitions, rehabilitations and developments.
- Actively engaging with the U.S. Department of Housing and Urban Development (HUD), The Texas General Land Office (GLO), Federal Emergency Management Agency, and other state and local authorities to ensure the client department abides by and remains compliant with all federal, state and local fair and affordable housing requirements.
- Negotiating and drafting agreements, including inter-creditor and subordination agreements, with commercial lenders, nonprofit and for-profit developers, tax credit investors, agencies, other governmental entities, and other stakeholders in affordable housing projects.
- Drafting ordinances that relate to various HCDD matters including program guidelines, affordable housing programs and agency agreements.
- Reviewing and commenting on proposed fair and affordable housing laws and regulations.
- Performing title review and drafting documents related to the City's down payment assistance and single-family home repair, construction and reconstruction programs.
- Rendering legal advice to HCDD and other City departments regarding housing and general real estate law and land use matters.
- Drafting, reviewing or revising city policies to further the City's goal of providing fair and affordable housing in the City of Houston.
- MINIMUM REQUIREMENTS
EDUCATIONAL: Requires a Doctor of Jurisprudence degree from an American Bar Association accredited college of law.
EXPERIENCE: Requires a minimum of 6 years of experience handling affordable housing acquisition, rehabilitation, and development.LICENSE: Must be a member of the Texas State Bar.
Preference will be given to applicants that possess:
- Excellent communication skills.
- Experience working with HUD, GLO, FEMA, and other federal, state, and local agencies.
- Experience working with real estate developers and commercial lenders working on affordable housing projects.
- Experience with project management.
- Experience drafting and negotiating contracts, loans, and grants for affordable housing, public services and/or public facilities.
- Excellent drafting skills.
- Excellent analytical skills.
- Excellent organizational skills.
- Familiarity with Texas real property statutes.
- Familiarity with municipal or public law.
- Familiarity with procurement requirements, policies and procedures.
- Experience providing legal and tax advice to city officials regarding Community Land Trusts.
- Must be willing to work extended hours as needed to accommodate work load demands.
- Proficiency with Word, Outlook, Excel and the use of technology in the practice.
Additionally, the selected applicant should be knowledgeable about HUD affordable housing, public facilities and public services programs, federal Home Investment Partnerships Program, federal Community Development Block Grants, federal Emergency Solutions Grants, federal Housing Opportunities for Persons with Aids Grants, federal Section 108 Loan Guarantee Program/Economic Development Initiative funds, Tax Increment Reinvestment Zone (TIRZ) and municipal bonds, City and TIRZ affordable housing funding methods, tax credit housing programs, and bond and commercial financing vehicles for housing and real estate.
**Preference shall be given to eligible veteran applicants provided such persons possess the qualifications necessary for competent discharge of the duties involved in the position applied for, such persons are among the most qualified candidates for the position, and all other factors in accordance with Executive Order 1-6.**
